By using Comm-ci and our Services, represent, understand and agree: (1) to accept, comply with, and be bound by these Terms, (2) that you have the right, authority and capacity to comply by these Terms, and (3) that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or any applicable jurisdiction in which Comm-ci conducts business.
We reserve the right to update, modify or otherwise alter these Terms and notices under which our Services are offered, including, but not limited to, any charges associated with the use of the Comm-ci services and such updates, modifications or alterations shall be deemed retroactive unless otherwise noted as of your original date of agreement to these Terms. You are responsible for regularly reviewing these terms and conditions. Any access or use of the Services after the changes go into effect shall constitute your agreement to the revised Terms.
Copyright & intellectual property
All of the intellectual property rights to all content on the Comm-ci website, including but not limited to trade marks, patents, copyrights, designs, methods and trade secrets are Comm-ci’s property only. These rights apply, inter alia, to the graphic design of the Comm-ci website, the databases therein (including but not limited to the product lists, the product descriptions etc.), the website’s computer code and any other detail associated with the operation thereof.
No commercial use will be made of the data published on the Comm-ci website, the database on the website, the lists and pictures of products appearing on the website or other details that are published by and/or on behalf of Comm-ci without obtaining Comm-ci’s consent to do so in advance and in writing.
No use will be made of any data published on the Comm-ci website for the purpose of displaying them on a website or other service contrary to the provisions in the agreement and/or without obtaining Comm-ci’s consent to do so in advance and in writing and subject to the conditions of such consent (if and insofar as given). Inter alia it is prohibited to collect data from the website through software and/or to distribute such data in public in a commercial manner or in a commercial framework.
No information will be copied, duplicated, distributed, sold, marketed and translated from the website (including but not limited to trade marks, pictures, texts and computer code without obtaining Comm-ci’s explicit permission to do so in advance and in writing.
The website will not be displayed within a blatant or concealed Frame and no links will be made to the pages in the website (“Deep Link”) but rather only to the home page.
The website will not be displayed in various graphic designs or interfaces designed by Comm-ci unless Comm-ci’s consent was given in advance and in writing to do so.
The name Comm-ci Ltd., the brand name product Comm-ci, Comm-ci’s trade marks (whether registered or not) and such like - all are Comm-ci’s property only. No use will be made thereof unless its consent to do so was given in advance and in writing.
Icons, any information and/or displays appearing on the website, including but not limited to graphics, design, verbal displays, trade marks, logos and the editing and displaying of these are exclusively owned by Comm-ci and/or anyone on its behalf. The content appearing on the website will not be copied, duplicated, distributed, publicized or used by any other means unless Comm-ci gave its consent to do so in advance and in writing.
Warranty, Security and Privacy
Comm-ci and/or anyone on its behalf operate common practiced precautionary measures in order to keep, insofar as possible, the information secret.
The User’s personal details (name, e-mail and such like), will be kept in Comm-ci’s database. The Comm-ci website is a secure website , that is to say, the data fed into the system by customers upon registering and/or surfing and/or purchasing a product will be kept confidential and secure.
It is stressed: the credit card details of Users concluding transactions through the website are not kept in the Comm-ci systems since Comm-ci uses an external company for the purpose of clearing credit cards.
It is clarified that since we are referring to online transactions, Comm-ci is unable to guarantee absolute immunity against its computers being hacked or the stored information being exposed by those committing illegal actions and therefore if a third party succeeds in hacking the information that is kept by Comm-ci and/or abuses the information, the User will have no allegations, claims or demands against Comm-ci. Likewise, in cases deriving from a force majeure, Comm-ci will not be liable for any damage of any type, indirect or direct, the User or anyone on its behalf sustains if any information that is remitted is lost or reaches a hostile entity and/or any unauthorized use is made thereof.
Comm-ci undertakes that it will not make any use of the Users details registered with the website other than for the purpose of operating the website and in order to allow for purchases to be transacted through the website as well as for the purpose of keeping in contact with the User. Notwithstanding the foregoing, Comm-ci will be entitled to transfer the User’s personal details to a third party in the event the User committed an act or omission that hurts or is likely to hurt Comm-ci and/or third parties, the User used the Comm-ci services to commit an illegal act, if Comm-ci receives a judicial order instructing it to remit the User’s details to a third party and in respect of any dispute or legal proceeding.
Likewise, Comm-ci may use the User’s personal details, without identifying the specific User for the purpose of statistical analysis of the information and presenting it and/or delivering it to other entities.
The operator of the Website and/or the holder of the rights to the website, Comm-ci. and/or their agents (hereinafter together and individually: “the Operator”), will not be responsible for any damage, direct, indirect, consequential or incidental due to accessing or using the Website or due to any denial of access to or use of the Website, for any cause (including contractual and/or tort cause). The Website is being used at the responsibility of the User only and it is clarified that the Operator is not responsible for any information that is uploaded by external users. The Operator is not responsible for any damage, including due to “viruses” and/or faults and/or software applications of different types, the computer equipment of the User or any other property of the User, which are sustained due to access to, browsing or use of the Website, including downloading information from the Website.
Links to the Website and additional services
The Website may have links or redirections to websites and/or redirections that are not run by the Operator. The Operator will assume no responsibility for linked websites and the link to any website does not constitute a recommendation thereof. The links are intended only for the convenience and information of the users. The Operator may, at its sole discretion, remove any link from the Website and/or add additional links.
Disclosing of details
A user who gives his particulars on the website for receiving an answer to his questions from the Operator does so at his discretion and free will, without this imposing any duty on the Operator. The Operator may use details given by the User within his visit at the Website for analysis and giving of statistic or other information to third parties, as long as this information does not identify the User personally by name.
The content displayed on the Website
The items displayed on the Website are for sale at the Operator’s stores until liquidation of inventory or sooner, subject to the Operator’s exclusive discretion. The Operator is not obligated to have the displayed items on sale at every one of the Operator’s stores. The photos and/or the descriptions and/or the designs of the items as shown on the Website are for illustration purposes only. In case of discrepancy between the price of an item displayed on the Website and the actual price displayed in the stores, the binding price shall be the price displayed in the stores.
